  16.    SEC. 160001. PENALTIES FOR INTERNATIONAL TRAFFICKING IN CHILD
  17.    PORNOGRAPHY.

  21.    (a) Import Related Offense .-Chapter 110 of title 18, United
  22.    Code, is amended by adding at the end the following new
  23.    
  24.    
  25.    
  26.    " 2258. Production of sexually explicit depictions of a minor
  27.    importation into the United States
  28.    
  29.    
  30.    
  31.    "(a) Use of Minor .-A person who, outside the United States, employs,
  32.    uses, persuades, induces, entices, or coerces any minor to engage in,
  33.    or who has a minor assist any other person to engage in, or who
  34.    transports any minor with the intent that the minor engage in any
  35.    sexually explicit conduct for the purpose of producing any visual
  36.    depiction of such conduct, intending that the visual depiction will be
  37.    imported into the United States or into waters within 12 miles of the
  38.    coast of the United States, shall be punished as provided in
  39.    subsection (c).

  43.    "(b) Use of Visual Depiction .-A person who, outside the United
  44.    States, knowingly receives, transports, ships, distributes, sells, or
  45.    possesses with intent to transport, ship, sell, or distribute any
  46.    visual depiction of a minor engaging in sexually explicit conduct (if
  47.    the production of the visual depiction involved the use of a minor
  48.    engaging in sexually explicit conduct), intending that the visual
  49.    depiction will be imported into the United States or into waters
  50.    within a distance of 12 miles of the coast of the United States, shall
  51.    be punished as provided in subsection (c).

  55.    "(c) Penalties .-A person who violates subsection (a) or (b), or
  56.    conspires or attempts to do so-
  57.    
  58.    
  59.    
  60.    "(1) shall be fined under this title, imprisoned not more than 10
  61.    years, or both; and
  62.    
  63.    
  64.    
  65.    "(2) if the person has a prior conviction under this chapter or
  66.    chapter 109A, shall be fined under this title, imprisoned not more
  67.    than 20 years, or both.".

  71.    (b) Technical Amendment .-
  72.

  75.    (1) Chapter analysis .-The chapter analysis for chapter 110 of title
  76.    18, United States Code, is amended by adding at the end the following
  77.    new item:

  81.    "2258. Production of sexually explicit depictions of a minor for
  82.    importation into the United States.".

  86.    (2) Fine provisions .-Section 2251(d) of title 18, United States Code,
  87.    is amended-

  90.    
  91.    (A) by striking "not more than $ 100,000, or" and inserting "under
  92.    this title,";
  93.

  95.    
  96.    (B) by striking "not more than $ 200,000, or" and inserting "under
  97.    this title,"; and
  98.    
  99.

  101.    (C) by striking "not more than $ 250,000'' and inserting "under this
  102.    title".

  106.    (c) Section 2251 Penalty Enhancement .-Section 2251(d) of title 18,
  107.    United States Code, is amended by striking "this section" the second
  108.    place it appears and inserting "this chapter or chapter 109A".

  112.    (d) Section 2252 Penalty Enhancement .-Section 2252(b)(1) of title 18,
  113.    United States Code, is amended by striking "this section" and
  114.    inserting "this chapter or chapter 109A".

  118.    (e) Conspiracy and Attempt .-Sections 2251(d) and 2252(b) of title 18,
  119.    United States Code, are each amended by inserting ", or attempts or
  120.    conspires to violate," after "violates" each place it appears.

  124.    (f) RICO Amendment .-Section 1961(l) of title 18, United States Code,
  125.    is amended by striking "2251- 2252" and inserting "2251, 225, 2252,
  126.    and 2258".

  130.    (g) Transportation of Minors .-Section 2423 of title 18, United States
  131.    Code, is amended-
  132.

  135.    (1) by striking "(a) Whoever" and inserting "(a) Transportation With
  136.    Intent To Engage in Criminal Sexual Activity .-A person who"; and
  137.    
  138.    
  139.    
  140.    (2) by adding at the end the following new subsection:

  143.    
  144.    "(b) Travel With Intent To Engage in Sexual Act With a Juvenile .-A
  145.    person who travels in interstate commerce, or conspires to do so, or a
  146.    United States citizen or an alien admitted for permanent residence in
  147.    the United States who travels in foreign commerce, or conspires to do
  148.    so, for the purpose of engaging in any sexual act (as defined in
  149.    section 2245) with a person under 18 years of age that would be in
  150.    violation of chapter 109A if the sexual act occurred in the special
  151.    maritime and territorial jurisdiction of the United States shall be
  152.    fined under this title, imprisoned not more than 10 years, or both.".

  156.    SEC. 160002. SENSE OF CONGRESS CONCERNING STATE LEGISLATION REGARDING
  157.    CHILD PORNOGRAPHY.

  161.    It is the sense of the Congress that each State that has not yet done
  162.    so should enact legislation prohibiting the production, distribution,
  163.    receipt, or simple possession of materials depicting a person under 18
  164.    years of age engaging in sexually explicit conduct (as defined in
  165.    section 2256 of title 18, United States Code) and providing for a
  166.    maximum imprisonment of at least 1 year and for the forfeiture of
  167.    assets used in the commission or support of, or gained from, such
  168.    offenses.

  172.    SEC. 160003. CONFIRMATION OF INTENT OF CONGRESS IN ENACTING SECTIONS
  173.    2252 AND 2256 OF TITLE 18, UNITED STATES CODE.
  174.    
  175.    
  176.    
  177.    (a) Declaration .-The Congress declares that in enacting sections 2252
  178.    and 2256 of title 18, United States Code, it was and is the intent of
  179.    Congress that-
  180.    
  181.    
  182.    
  183.    (1) the scope of "exhibition of the genitals or pubic area" in section
  184.    2256(2)(E), in the definition of "sexually explicit conduct", is not
  185.    limited to nude exhibitions or exhibitions in which the outlines of
  186.    those areas were discernible through clothing; and
  187.    
  188.    
  189.    
  190.    (2) the requirements in section 2252(a) (1)(A), (2)(A), (3)(B)(i), and
  191.    (4)(B)(i) that the production [*H8838] of a visual depiction involve
  192.    the use of a minor engaging in "sexually explicit conduct" of the kind
  193.    described in section 2256(2)(E) are satisfied if a person photographs
  194.    a minor in such a way as to exhibit the child in a lascivious manner.

  198.    (b) Sense of the Congress .-It is the sense of the Congress that in
  199.    filing its brief in United States v. Knox, No. 92-1183, and thereby
  200.    depriving the United States Supreme Court of the adverseness necessary
  201.    for full and fair presentation of the issues arising in the case, the
  202.    Department of Justice did not accurately reflect the intent of
  203.    Congress in arguing that "the videotapes in (the Knox case) constitute
  204.    'lascivious exhibition(s) of the genitals or pubic area' only if those
  205.    body parts are visible in the tapes and the minors posed or acted
  206.    lasciviously.".
